the ancestors of the 1st Earl of Mar had been Mormaers of Mar since the earliest times;  in 1115 he was witness to the foundation charter of Scone Abbey as "Rothri, Comes" and so it is from this date that the Earldom of Mar is taken to originate; also witnessed between 1124 and 1129 the charter of King David I to Dunfermline Abbey and in 1131-32 a charter of Gratney, Mormaer of Buchan, to the monastery of Deer

on 23 Jun 1565 the Earldom was restored to him by charter from the Crown as heir general of the Countess Isabel;  on 25 Feb 1875, however, the Committee for Privileges held that the dignity of Earl has not been restored by this charter along with the lands, and the Crown must have conferred on him a few weeks later a titular Earldom of Mar, with remainder to his issue male, despite there being very little evidence for such a creation

 

This decision by the Committee for Privileges is remarkable, to say the least.  Whilst one would hesitate to say that their Lordships were wrong and there was no Earldom of Mar created in 1565, the logic behind the 1875 decision is questionable.  If one concurs with their Lordships' decision then one must also accept amongst other things: (1) that it was created with a different limitation to that of the Earldom restored at the same date, which, having been inherited by the Erskine family from heirs general, was restored to such heirs;  (2) that it is acceptable that the patent or charter supposed to have effected such a creation has never been registered nor has there been any record of it ever being seen by any one;  (3) that the new creation was apparently unknown in 1606 at the "decreet of ranking" when the Earldom of Mar was ranked, following the evidence of the charters of 1395 and 1404, between the Earldom of Sutherland (1347) and the Earldom of Rothes (1459);  (4) it is not unusual that the only Earldom of Mar that figures on the Union Roll in 1707 is the one that ranks immediately after the Earldom of Sutherland;  (5) that the 1824 Act of Parliament which restored the Earldom of Mar to John Francis Erskine was in error in that it restored him as "grandson and lineal representative" (i.e. through his mother) of the attainted John [Erskine], 23rd Earl of Mar - the Act makes no mention that he also happens to be great-nephew and collateral heir male through his father, the paternal cousin of his mother; and (6) that the trustees who purchased the lands of the attainted 23rd Earl in 1725 were wrong in settling those lands on the heirs general.
