Commissioner of Musters, co. Durham 1569; in 1569 he joined the Earl of Northumberland in an attempt to set free Mary, Queen of Scots, from Tutbury Castle and restore Roman Catholicism - they captured Barnard Castle and Hartlepool but fled to Scotland before the advance of the Earl of Sussex - the Earl of Westmorland eventually escaped to the Spanish Netherlands in 1570; he was attainted in absentia in 1571 and the Earldom of Westmorland and the two Baronies of Nevill were forfeited; Captain of all the English under the Duke of Parma 1583 and with Parma in Flanders 1588 prior to the sailing of the Armada

 

On the attainder of the 6th Earl of Westmorland in 1571 the Earldom of Westmorland and the two Baronies of Nevill were forfeited. The title was revived in 1624 by a grant of the Earldom to Francis Fane.
