his father was tried and found guilty of high treason in 1680 and was attainted and all his honours forfeited; his parents had been created jointly 12 Sep 1640 Baron and Baroness Stafford, with remainder to the heirs male of their bodies, failing which, to the heirs of their bodies, and on 11 Nov 1640 the 1st Baron Stafford had been created Viscount of Stafford; following the execution of Viscount Stafford on 29 Dec 1680 his widow, suo jure Baroness Stafford, continued to be known as Viscountess Stafford; in 1688 she and her eldest son were created respectively Countess and Earl of Stafford in the same patent; on her death in 1693/4 the Earldom of Stafford, granted to her for life in 1688, became extinct, and the Barony of Stafford, the right to which devolved on her children, could not be inherited by them because of the attainder of their father and so became forfeited

On the death of the 4th Earl of Stafford the Earldom of Stafford became extinct as did also any rights to the attainted Viscountcy of Stafford, but the right to the Barony of Stafford (cr. 1640) passed, subject to the attainder of 1680, to the heirs general of the body of the 1st Baron Stafford
