he lived throughout his life in retirement at Standon Lordship and took no part in public life due to the severity of the penal laws against Roman Catholics; on his death the Baronetcy of 1611 became extinct
On the death of the 5th Lord Aston of Forfar, the peerage, in accordance with the terms of the 1627 patent, devolved on the heir male general of the grantee; this appears to have been his fifth cousin once removed, William Aston of Beaulieu, whose descent is given below.
However, there is no firm evidence that the lines of Herbert Aston or of John Aston, brothers of the 2nd Lord Aston of Forfar, or of Thomas Aston, his uncle, are extinct. The heir of anyone of these three, if such existed, would have taken precedence of the aforesaid William Aston.
On or shortly after the death of the 5th Lord Aston of Forfar the peerage was assumed as below. Of these claimants it is obvious that the first two, Philip Aston and his brother Walter Aston, were nor entitled to the Lordship of Aston of Forfar, as their descent was from the fourth son of Sir Walter Aston (grandfather of the 1st Lord Aston of Forfar), while the abovementioned William Aston (their distant relative in Ireland, of whose existence they were probably unaware), descended from the second son. As regards the third claimant to this title, however, Walter Aston the watchmaker, the succession must have opened to him on the death of William Aston in 1769 (assuming that the male issue of Robert Aston of Park Hall then became extinct), subject only to the remote possibility of the uncle or one of the two brothers of the 2nd Lord Aston of Forfar having then a surviving heir male
