in 1576 he joined with other "Lords of the Pale" in a complaint as to taxes being levied without the saction of the Irish Parliament, and subsequently joined with the Earl of Desmond in a conspiracy to place the Queen of Scots on the English and Irish throne - when this failed he fled from Ireland to Spain in 1581; for this he was outlawed and his title forfeited, being described as "James Eustace late Viscount Baltinglass" in the Act of Parliament for the attainder of the family honours and the forfeiture of the entailed estates in May 1585, some six months before his death; four of his brothers also took part in the same rebellion and, although all dead, were included in the attainder

 

On the attainder of the 3rd Viscount Baltinglass the Viscountcy of Baltinglass became forfeited.
