On the death of the 1st Earl FitzWalter the Earldom of FitzWalter and the Viscountcy of Harwich became extinct but the Barony of FitzWalter fell into abeyance amongst the issue of his aunt, Hon Mary Mildmay, the only sister of the 16th and 17th Barons FitzWalter. The abeyance was terminated 30 Sep 1924 after nearly 169 years in favour of one of the co-heirs, Henry FitzWalter Plumptre.
