suc. his father May 1689 as 3rd Baronet of Glenae; a supporter of the Stuart cause, he was captured after the Battle of Preston 1715, impeached before the House of Lords 19 Jan 1715/6 and on 9 Feb 1715/6 sentenced to death as a traitor and, being thereby attainted, forfeited both his landed estates and his Peerage honours; his sentence of execution was respited and later remitted
Following the attainder of the 5th Earl of Carnwath the Earldom of Carnwath was under forfeiture from 9 Feb 1715/6 until 26 May 1826 when Maj Gen Robert Alexander Dalzell, a grandson of the 5th Earl of Carnwath, obtained an Act of Parliament "for the restoration to the dignity and title of Earl of Carnwath", and accordingly he was summoned to Parliament as,
