Following the death of the 5th Duke of Gordon in 1836 the Marquessate of Huntly was claimed by the heir male, George Gordon, 5th Earl of Aboyne. In their decision of 1838 the Committee for Privileges allowed the claim to the Marquessate of Huntly but inexplicably did not allow a similar claim to the Earldom of Enzie or the Lordship of Gordon of Badenoch, even though these peerages had been created with the Marquessate of Huntly in 1599.
