Following the death of the 5th Duke of Gordon on 28 May 1836 the Marquessate of Huntly was claimed by the heir male, George Gordon, 5th Earl of Aboyne.  In their decision dated 21 Jun 1838 the Committee for Privileges allowed the claim to the Marquessate of Huntly but did not allow a similar claim to the Earldom of Enzie or the Lordship of Gordon of Badenoch, even though these peerages had been created with the Marquessate on 17 Apr 1599.


The Committee for Privileges also disallowed the Earl of Aboyne's claim to the Earldom of Huntly.  It was argued that the Earldom of Huntly was created with remainder to heirs whatsoever and so had a different destination to the Marquessate of Huntly, which was created with remainder to heirs male;  it was also put forward that the Earldom was not surrendered when the Marquessate was created.  If this line of argument is accepted, then the Earldom of Huntly should be held by the Duke of Richmond, Lennox and Gordon as heir of line.  However, if the restoration by Act of Parliament to the 3rd Marquis of Huntly was not a general one but one with a special remainder to heirs male for all the titles held by the attainted 2nd Marquess of Huntly, then the Earldom of Huntly would belong to the Marquess of Huntly as the heir male of the family.
